Basic Terms of Service

This Service Agreement with Big B Managed Services hereafter called ISP/IPP; to provide Internet Services, including Website Development, Website Hosting and Promotions, Hourly Consultation, Internet Access including PPP accounts on our computer system. You are being charged for having these services rendered and/or accounts active and available to you. All accounts are paid in advance. ISP/IPP provides no software or installation disks to our subscribers and does not warranty any software. There is NO REFUND FOR NON-USE OR NON-ACCESSIBILITY, OR ADVANCED PAYMENT, except for system outage. The term "unlimited PPP Account" means an account for reasonable, dial-up usage. You are not permitted to maintain an open connection for unreasonable periods of time, use multiple simultaneous logons, use software which runs automatically, visiting numerous web sites gathering information (robots), send unsolicited E-mail (Junk mail, SPAM, or mail bombs), or use the system to store illegal copies of copyrighted material. ISP/IPP will not be liable for direct, indirect of consequential damages of any kind by the use of the system. Hacking (breaking in to other computers) is illegal, and will not be tolerated. ISP/IPP will work in cooperation with government authorities to provide any information needed to prosecute backing or the breaking of any law. ISP/IPP is not responsible for the data found on the Internet. Some material may be objectionable to some users. CANCELLATIONS MUST BE MADE IN WRITING 30 DAYS PRIOR TO THE 1st DAY OF THE MONTH IN WHICH THEY ARE TO TAKE EFFECT IN ORDER TO AVOID BEING CHARGED. Accounts are due on the first day of the month and are considered late if not paid by the 10th. If your account becomes late your account will automatically be charged a recurring late fee of $5.00. If your account is not paid current by the 15th day or the month, your account will be terminated. There is an additional $20.00 reconnection service fee for reactivating accounts that have been terminated for any reason. No SPAMming

Big B Managed Services, hereinafter identified as ISP/IPP has established and enforces the following No SPAMming policy. We have a ZERO TOLERANCE policy on SPAMming which results in the immediate cancellation of any offenders account without notice. There is no refund for nonuse of remaining access terms. There will be no reconnection to the Big B Managed Services / Affiliate network. The term "unlimited PPP Account" means an account for reasonable, dial-up usage. E-mail SPAM

Sending unsolicited mail messages, commonly called unsolicited commercial E-mail ("UCE") including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.

In addition, we use the Real Time Blackhole List to minimize the amount of UCE that enters our network, further protecting our customers.

USENET SPAM

Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, also known as "SPAM") is explicitly prohibited.

INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A Big B Managed Services CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

Illegal Use

This goes beyond network policy, violations will be investigated and prosecuted to the extent of the law.

The Big B Managed Services and affiliates Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Network Security

Violations of system or network security are prohibited, and may result in criminal and civil liability. Big B Managed Services will help to investigate all incidents involving such violations and may involve and will cooperate with local, state and Federal law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.

Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
Interference with service to any user, Host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.

Forging of any TCP/IP packet header or any part of the header information in an E-mail or a newsgroup posting.
